1. Acceptance of Terms

By accessing or using the HANGUKVERSE online store ("we," "our," "us"), operated by LUMANTARA PVT LTD, you ("user," "you," "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our store.

2. Eligibility

You must be at least 16 years of age to use our store. If you are between 13 and 16 years old, you may only use our store with the consent and supervision of a parent or legal guardian. Users under 13 are not permitted to use our store in compliance with Indian data protection regulations.

3. About Our Products

HANGUKVERSE operates on a print-on-demand (POD) model through our fulfillment partner Printrove. This means:

  • All products are custom-made and manufactured specifically for your order
  • Production begins immediately upon order confirmation
  • We do not hold inventory or produce items in advance
  • Slight variations in color, size (±1-2cm), and design placement are inherent to the printing process and do not constitute defects

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate, current, and complete information during registration
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account at fans@hangukverse.com

5. Orders and Payments

5.1 Placing Orders:

  • All orders are subject to acceptance and availability
  • We reserve the right to refuse or cancel any order for any reason, including pricing errors
  • Order confirmation does not guarantee delivery; it confirms that we have received your order

5.2 Pricing:

  • All prices are listed in Indian Rupees (INR) unless otherwise stated
  • Prices include applicable taxes unless stated otherwise
  • We reserve the right to change prices at any time without prior notice
  • Price changes will not affect orders already confirmed

5.3 Payments:

  • Payments are processed securely through Shopify Payments and/or third-party payment processors
  • We accept payment methods as displayed at checkout
  • Full payment is required at the time of order placement

6. Shipping and Delivery

  • We ship across India through Printrove's fulfillment network
  • Estimated delivery times are provided at checkout and are not guaranteed
  • We are not responsible for delays caused by shipping carriers, customs, natural disasters, or events beyond our control
  • Risk of loss passes to you upon delivery to the shipping carrier

7. Returns, Refunds, and Cancellations

  • All sales are final. We do not accept returns or exchanges once an order has been placed
  • Refunds are available only for defective, damaged, incorrect, or undelivered items
  • Order cancellations are possible only before production starts (within 24-48 hours)

8. Permitted Use

You agree to use our store only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable local, state, or national law
  • Transmit any harmful, threatening, abusive, harassing, defamatory, or obscene material
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the store or its servers
  • Attempt to gain unauthorized access to any portion of the store
  • Use automated systems (bots, scrapers) without our express written permission
  • Use the store for any fraudulent or illegal purpose

9. Intellectual Property Rights

All content on our store, including text, graphics, logos, images, designs, software, and other materials, is the property of HANGUKVERSE (PRODUCT BY LUMANTARA PVT LTD) or its licensors and is protected by copyright, trademark, and other intellectual property laws in India.

You are granted a limited, non-exclusive, non-transferable license to access and use the store for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or modify any content without our written permission
  • Use our designs, logos, or branding for any commercial purpose
  • Download or copy content for resale or commercial use

10. User-Generated Content

By submitting content to our store (such as reviews or comments), you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, and display such content.

You represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • Your content does not violate any third-party rights
  • Your content does not violate these Terms or applicable laws

11. Third-Party Links and Services

Our store may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of such third parties. Your use of third-party services is at your own risk.

12. Disclaimer of Warranties

THE STORE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The store will be uninterrupted, secure, or error-free
  • The results obtained from using the store will be accurate or reliable
  • Product colors on screen will exactly match the physical product
  • Any errors in the store will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANGUKVERSE (PRODUCT BY LUMANTARA PVT LTD) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claim arising from these Terms or your use of the store shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless HANGUKVERSE (PRODUCT BY LUMANTARA PVT LTD), its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your use of the store
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kolhapur, Maharashtra, India.

16. Complaint Resolution

If you have a complaint regarding our store or services:

  • Email us at fans@hangukverse.com with details of your complaint
  • We will acknowledge receipt within 2 business days
  • Simple complaints will be resolved within 5-7 business days
  • Complex complaints will be resolved within 15-30 business days

If you are not satisfied with our response, you may:

  • Contact the National Consumer Helpline at 1800-11-4000
  • File a complaint with the Consumer Forum
  • Reach out to the appropriate consumer protection authority

17. Termination

Termination by You: You may stop using our store at any time. To delete your account, email fans@hangukverse.com.

Termination by Us: We may suspend or terminate your access to the store under the following circumstances:

With Immediate Effect:

  • Violation of these Terms
  • Fraudulent, illegal, or harmful activity
  • Payment fraud or chargebacks
  • Court order or legal requirement

With Notice (Minimum 30 Days):

  • Extended account inactivity (no login for 12+ months)
  • Discontinuation of the store or specific features

Upon termination:

  • Your right to access and use the store immediately ceases
  • Pending orders will be fulfilled unless terminated for fraud
  • We may retain certain data as required by law (see Privacy Policy)

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the store. Continued use of the store after changes constitutes acceptance of the modified Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and HANGUKVERSE regarding your use of the store.
